SunSmart SC - Special Conditions for Solar Contract

  1.  Subject to Site Inspection


    1.1  Notwithstanding Clause 6.1 of the Terms and Conditions, this solar proposal is subject to a satisfactory site inspection of the Property. The purpose of the site inspection is to identify the suitability of the Solar System; the configuration of the panels; quantity of panels needed; layout of the panels; standard of the meter box; proposed inverter location and inspection of the roof (including roof material).

    1.2  The System Price is indicative only and will be confirmed following the site inspection of the Property. Should the System Price change, notification will be given to the Owner in the form of an updated solar proposal, and acceptance of the new System Price will be required by the Owner, prior to installation (even if a Deposit has already been paid).

  2.  Changes and variations


    The Owner acknowledges that on the day of installation, the installer may need to make changes to the layout of the panels, location of the panels and placement of the inverter due to factors identified on the day of installation. In such circumstances, the Owner shall not be entitled to raise any objection or terminate the agreement provided that the changes are required in order to ensure functionality of the Solar System. The Owner must sign an updated solar proposal to acknowledge the changes/variations and the Retailer reserves the right to cease undertaking further work until the updated solar proposal has been signed by the Owner.

  3.  Major Variation


    3.1  The Owner acknowledges and agrees that the System Price is subject to change if there is a Major Variation.

    3.2  “Major Variation” means:
      3.2.1  changes to the original scope of works;
      3.2.2  works outside the original site inspection including changes that are beyond the control of the Retailer such as staggered timelines rather than continuous working days, delayed installation works, change in equipment schedule and identification of issues with the structural integrity of the Property;
      3.2.3  identification of asbestos or other hazardous material;
      3.2.4  any other circumstance beyond the control of the Retailer;
      3.2.5  expenses which arise from hidden or unknown contingences found at the Property that were not observable at the time of the site inspection or were not clearly communicated during initial discussions so as to be included in the original System Price.

    3.3  The solar proposal provided by the Retailer is based on the information provided by the Owner during the original site inspection. The Retailer reserves the right to revise the System Price if there are any changes in the scope of work, a Major Variation arises or if additional components are required.

  4.  Asbestos


    4.1  The System Price does not include any provision for the costs of removing or handling any materials that contain asbestos or hazardous material.

    4.2  If the Retailer suspects that any material in the vicinity of the Property or that forms part of the works under this agreement contains asbestos or hazardous materials then the Owner must arrange and pay for all costs associated with testing for the presence of asbestos or hazardous material and the removal of same. Any delays to the installation of the Solar System as a result are considered a Major Variation and may trigger a recalculation of the System Price.

  5.  Estimates only


    5.1  The Owner acknowledges that this solar proposal has been prepared in reliance on the information the Owner has provided to the Retailer, including information relating to past electricity bills.

    5.2  The financial summary and analysis provided in this proposal, including daily supply charges, are estimates only. The Retailer will not be responsible for any inaccuracies in the financial summary and analysis including as a result of inaccurate information provided by the Owner to the retailer used to prepare this proposal; price increases imposed by Electricity Retailers or any change in the outcome of the financial analysis including return on investment due to the impact of items such as air conditioning or pool operation at the Property.

  6.  Shading Disclosures & Other Performance Factors


    6.1  The Owner acknowledges that shading from trees or nearby structures have been discussed throughout the design process and shading may affect the estimated outcome of the Solar System. In such circumstances, the Owner shall not be entitled to raise any objection, terminate the agreement, or claim compensation from the Retailer.

    6.2  The Owner further acknowledges that the estimated outcome of the Solar System can be affected by a variety of factors including, but not limited to, overcast weather, rain, cable losses, debris/dirt on the panels, scheduled downtime, manufacturer tolerances, inverter efficiency for DC to AC (this does not affect off-grid DC only systems) and battery efficiency, and the Owner shall not be entitled to raise any objection, terminate the agreement, or claim compensation from the Retailer for such factors.

  7.  Export Limits on Solar System


    7.1  The Owner acknowledges that solar export limiting is determined by your Distributed Network Service Provider (DNSP), being Energex or Ergon Energy, depending on your location. Your chosen energy retailer (i.e. AGL) will be bound by the solar export limits imposed by the DNSP.

    7.2  Solar export limiting is where your local electricity provider sets a limit on the amount of energy your solar system can export to the grid. This is to protect the energy network in areas with individually owned solar connected to the grid to stop grid volatility issues (i.e. power surges, drop in quality of the electricity and power cuts). Depending on your location, your energy retailer may impose export limits or require you to participate in additional programs (such as dynamic or flexible exports). Dynamic or flexible exports mean that your solar system can push as much energy as it can manage out into the grid, unless there is a network event or minimum demand emergency. If this happens, the DNSP will activate a Generation Signalling Device (GSD) installed at your Premises to turn systems off and limit exports on flexible connections.

    7.3  The Solar System production and savings will vary (change) based on your energy usage post installation and as a result of any export limits imposed by your DNSP.

    7.4  The Retailer has no control over solar export limiting and you should ensure that you understand any limitations imposed by your DNSP.   8.  Connection to Internet


    The Owner acknowledges that monitoring of the Solar System requires internet connection. It is the Owners sole responsibility to maintain the internet connection. The 5 year Contractual Warranty does not extend to any issues associated with failed/interrupted internet connection which may affect the Solar System monitoring.

  9.  Credit Card Payments


    Credit card payments are provided by a third party provider and will incur a credit card surcharge.

  10.  Finance Options


    The Owner may choose to finance the Solar System using a third party finance provider. The Retailer is not affiliated with and does not endorse or recommend any third party finance provider. Any finance calculation provided by the Retailer is indicative only and is subject to the approval criteria set by the third party finance provider.

  11.   Payment Milestones & Late Payments


    11.1  A late payment fee of $50.00 will be charged by the Retailer if you miss a Milestone Repayment. The late payment fee will be charged each month (or part thereof) until the Milestone Repayment has been paid in full.

    11.2  In addition to the late payment fee, the Retailer reserves the right to charge interest on any outstanding Milestone Repayment, calculated and charged at 10% per annum from the time the Milestone Payment falls due until the date the payment has been made in full.

    11.3  The Retailer reserves the right to refer any outstanding debt to a debt collection agency for recovery of any outstanding amount. In such circumstances, you are liable for any additional recovery charges applied to the account by the debt collection agency, in accordance with terms and conditions of the debt collection agency.

  12.  Access for non-payment and removal

    12.1  Despite Clause 7.2 of the Terms and Conditions, title to the Solar System shall remain vested in the Retailer until the date payment for the Solar System has been made in full and received by the Retailer.

    12.2  The Retailer shall have full and unfettered access to enter the site of the Property for the purpose of removing such goods and materials should payment not be received in full in accordance with the terms of this agreement and you shall not be entitled to raise any objection or prevent access.

  • Any damage caused to the system by natural events such as weather. We recommend obtaining a home insurance policy to cover such events.
  • Faults or damage due to tampering, modification or repairs by a party other than SunSmart SC.
  • Non-compliance with operating instructions.
  • Fault or damage caused by the electricity grid.
  • Fault or damage caused by external factors such as vandalism.
  • Improper use of the solar system.
  • Items that are aesthetically displeasing and only visually noticeable that do not impact the performance of the system. Any act omission, misuse, abuse, or damage (whether wilful, accidental or negligent)caused by you or a third party.

2. SunSmart SC will contact you following your claim submission, the issue will be discussed in detail and identified as to whether this is part of the 5 year Whole of System Warranty.

3. You provide recent photos and tools to diagnose the issue.

4. If determined to fall under the 5 year Whole of System Warranty, a qualified technician will be sent out to inspect/ repair the issue.

What happens after 5 years?

This warranty applies in addition to any statutory rights or remedies you may have, including under the Australian Consumer Law.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Should a fault or defect occur after the SunSmart SC 5 year Whole of System Warranty expires you may still seek to rely on the manufacturers product Sunsmart PVT NRG Pty Ltd Workmanship Warranty provided by the manufacturers for the components supplied as part of the Solar System.
